This study has the purpose of reviewing the relation between work, legal science and philosophy of law, aiming at highlighting the importance of the phenomenon for these branches of knowledge. Beliefs originating in the positivist tradition, which are the basis of the said scientific knowledge, could explain such a distance that is strictly rational, although derived from relations of power, ideology and interest of the classes that manage it, and the labor phenomenon, thus eliminated from the field of visibility of science and moved to the non-prestigious plan of non-science. On account of the failure of the plan of the so-called human sciences to connect with its own object, they prefer to act the way exact sciences do, that is, to embrace an alleged neutrality. Therefore, in this text, we urge for the need of a reassessment of principles and priorities of the legal knowledge, which must see what is outside again, thereby placing both man and work at the core of their concerns |
