Resumo: |
The present study is an interdisciplinary analysis of the collective relations of labour in Brazil since its social and economic conformation, as one estimated for the recognition of the necessity of a limitation to the private collective autonomy. This conclusion is established in the fact of that the Brazilian´s labour market and its regulation had been structuralized with distinct paradigms of those observed in other countries, over all of the Europe, what is an obstacle to the unconditional adoption the ample flexibility of the labor laws, despite based in collective bargainings. On the other hand, the syndical structure in Brazil is another factor that prohibits the possibilities of evolution of the collective bargaining model, still marked by typical elements of the corporative standard, what it contributes for the transformation of the collective bargaining in precariousness instrument and not of emancipation of the workers, as would have to be considered, also on account of its condition of fundamental rights, as is recognized for the International Labour Organization |
