The Constitution of 1998 watches, in a specific chapter, the Social Communication and identifies the Communication Law which involves information, entertainment and regulation of the means of communication. This issue aims to elucidate the constitutional parameters related to the way of the responsible for the programs and production in Radio and Television act, as well as, assure that those parameters are mandatory and what can be the consequences if they are not followed. Radio and Television are recognized as educational agents the main discussion in this issue according to article 221 of he Constitution where the broadcasting principles are mandatory, independently of the infraconstitutional law once, by that, citizenship and human dignity can become concrete, which must be underlined in democratic regimes. It is through interpretation of the Constitution that the bound to the educational process will be brought, highlighting the triple mission of education, described in article 205 of the Constitution. The program which takes into account those media support for broadcasting, identifies the proper place to implement educational acts which have as mission and social function the development of the humanbeing |
