A Lex mercatoria na teoria dos sistemas sociais autopoiéticos: conflitos entre racionalidades

Resumo: The present thesis aims to understand the logic behind lex mercatoria, which in essence, was associated to jus mercatorum, and nowadays, can be considered an order transnational, polycontextural, heterarchical, soft law; The objective is to establish a new perspective for the theme as a social subsystem, and to defend that it is possible for lex mercatoria to assume another rationality as a global economic law, which is not necessarily the one from economics or politics, moreover that lex mercatoria it is not fated to be corrupted by these systems, and when confronted, it can guide its programs to apply social values, rather than just economic calculations. In order to corroborate this thesis, the lex mercatoria was inserted in the context of autopoietic systems theory, aiming to investigate it as a social subsystem that coexists in global society with a plurality of other systems and transnational legal orders. The theory of self-referential systems allows us to detect the conflicts arising from the relation of lex mercatoria with other global social system and to evaluate the risk of systemic corruption, in addition to claim the autonomy of lex mercatoria as an autopoietic right. This theory has the quality of adopting new descriptions for social phenomena, in the case of lex mercatoria, it allows to identify a new legal order, reoriented by principles and social values promoted by the global civil society itself, that can prevail in the conflicts that involve lex mercatoria. For accomplish this work, theoretical research techniques were adopted, based mostly on bibliographical research, but also on deductive reasoning, with the development of sequence of arguments along the thesis content, each one to prove a step of the discourse
