Resumo: ABSTRACT Currently, it is stated that the Constitutions have a principled profile, that is, the provisions due to the Constitutional Texts prioritze ends to be achieved by the state and society, and also tasks to be performed by the state. Nonetheless its importance for the study of Constitutional Law, it is certain that the legal nature of the constitutional is still a complex matter due to the fact that up to the present time, it is still common to quote them above the rule of law. Moreover, the constitutional principles are quite frequently contradictory, demanding the predominance of one of them in the concrete case, and this predominant choice of the constitutional principle must be regulated by a method that may avoid either discretion or abuse by the Judicial, Executive or Legislative Departments. Finally, the constitutional principles may generate advantageous situations for individuals in the face of State or of another individual. Therefore, the pleading of such subjective rights is not very often protected by the Judicial Department for as a rule, the constitutional principles enjoy limited force, that is, there is no political will from either Executive or Legislative Departments to implement the ends or tasks imposed by those principles. The present study aims at analyzing the constitutional principles to recognize them as a rule of law in the first place, trying to demystify them. Afterwards, it is intended to easen the effectiveness of the constitutional principles with the suggestion of different criteria to be followed in order to solve occasional conflicts and also by restricting their applicability to concrete cases.
