The present dissertation objective the study of the dualism modification x stability in the Constitution contexts, whose solution depends on the perfect harmonization between the necessity of if imposing changes in the Basic Norm and the indispensability to make it under methods that prioritize the solidity of the constitutional text and the proper Constitution idea. In order to fulfill this necessity, the analysis of the proper nature of the Lex Mater becomes necessary, its structure, essence, extension and the system for which the rules inculpates in its body have to adapt to the dynamics of the reality, so that if it verifies where degree such characteristics influence in the attribute of the constitutional stability. Equally, carefully the ways will be verified how the Constitution suffers changes, since the adequate understanding of the formal methods (revision and amendment) and informal (constitutional mutation) of alteration of the basic rules in will allow to glimpse them and the narrow relation that exists between these and the guarantee of stability of the constitutional order. The work involves, likewise, extensive research how much to the characteristics of origin, structure and reform of the Brazilian Constitution of 1988 and, by valuing the rationalization of the methods of constitutional modification and detaching the irrevocably necessity of its developing fort constitutional conscience and true will of Constitution, formulates some proposals so that the constitutional stability also prevails in the national scene |
