Resumo: |
The present research fosters, from a phenomenological perspective, a dialogue with the various studies that involve scientific researches that use human beings as subjects of studies. The starting point is the pursuit of ethics and bioethics concepts, both analyzed within the scope of the historical-evolutionary moment presented. Afterwards, the research seeks to analyze the ethics guidelines that developed from transgressions occurred at various times in the history of humanity. These documents regulate the rights and duties of both researchers and research subjects and their objective is to prevent the abuse of human rights and to ensure scientific development at the same time. The research proceeds the analysis of different doctrinal currents regarding the rights and duties of the various actors involved in this area of scientific research, imputing responsibilities in all spheres of Law. Finally, the research presents the current stage of biomedical technology and its relationship with the Brazilian normative order and will reflect on the need to develop a Brazilian Code of Bioethics |
