Resumo: The object of study of this dissertation is the precautionary protection granted in the preceding nature. This is a novelty brought by brazilian civil procedural legislation, implemented by the Code of Civil Procedure of 2015 (Law n. 13.105/2015 of March 16, 2015). The system of CPC, with regard to provisional protection, proved to be the result of the development of severe debates among scholars to achieve the possibility of a more adjusted procedure. In particular, for our study, it involves precautionary protection in a antecedent nature, whose focus is maintained on ensuring satisfaction of the rights of the parties, taking into reference to the various premises regarding the theoretical profile and procedural requirements. It performs a systematized analysis of the historical evolution of the precautionary process and emphasizes the importance of the adequacy of the institutes studied to the constitutionally guaranteed postulates. It allows reflection on the influence of foreign law as a paradigm for the protection of urgency in Brazilian legislation. It addresses the provisional protection of urgency from the evolution of history and the views that the CPC received from the bills that preceded it. It deals with the classification of the protection of urgency, in order to create a solid basis to present an in-depth analysis of the precautionary protection required in the antecedent nature, highlighting and developing questions of greater importance. This is a descriptive study, developed from a historical and bibliographic analysis, for which we use the inductive method
