The objective of this work is related to the evolution of the struggle for Humanity in favor of Fundamental Rights. Today this fight is fought in the Constitucional Courts that are the guardians of the Constitutions, where the Fundamental Rights are listed. However, we are living an active moment in the performance of our Constitucional Court and this may come in contact with some Rights, such as that of representative democracy. Thus, with the intention of establishing guidelines in the judicial decisions of our Court, it is extremely important to analyze the progress of the Constitution and Constitutionalist Thought, mainly because the evolution of this idea is intrinsically linked to the progress of Fundamental Rights. And, finelly, to achieve the proposed objective, we will examine some court decisions of the STF
