The Constitution of the Federative Republic of Brazil enshrined among the fundamental rights and guarantees, the right to property and, thus, emphasizes that a property must fulfill its social function, a premise enshrined in the fundamental rights and guarantees of all citizens. As such, the timeshare institute, by enabling the use of the property by several owners of the real estate, contributes to the promotion of the economy, by allowing the sharing of property and allowing people to have access through the acquisition of determined fractions of time corresponding to the faculty of use and enjoyment, exclusively, of the entire property, to be exercised by the owners in an alternative way. In effect, an analysis of this institute includes a historical approach, which will be carried out from its origins and a consequent form of its application, up to the theoretical framework with the effective enactment of specific legislation in our order and as its different species. When analyzing the institute timeshare, there will be an analysis of its form of institution, the rights and obligations of the multi-owner, as well as the elements inherent to the transfer of the timeshare. In turn, the study will also address the condition of the condominium in timeshare without foreign law, analyzing the specific legislation on the subject, in addition to deepening the study on the controversial themes that affect the sphere of application of the timeshare
