The legal phenomenon of succession causa mortis is a rule of succession law in which there is transmission of assets to relatives. The organization of the succession itself is an important measure, as it brings greater utility to the assets that are part of the estate, as well as comfort and security to the heirs. The donation contract, along with other possibilities, is evident in the context of succession planning, as a tool for anticipating assets and rights. Succession planning is one of several ways to protect your own assets and organize the lives of the heirs and property holders. However, the order imposes limits and restrictions that are based on the principle of human dignity and protection of the existential minimum. In addition, the liberalities made in life, may produce reflections in the inventory process, imposing the duty of collation. Within this premise, the present work seeks to probe, analyze, compare and discuss the donation contract and its relationship with the law of succession from the logic of a planned succession. To achieve these objectives, the method of comparison between the Brazilian legal system and foreign legal systems is used, with a deductive-hypothetical and qualitative approach to the theme |
