Criminal dogmatics is an instrument of power that is increasingly abstract and subject to criticism, but, even within a delegitimizing perspective of Criminal Law, criminal dogmatics needs to be managed, within the logic of the society of conflict, insofar as oppression does not see a near end. In these terms, dogmatics, which historically is built based on consensus, urges counter-selective, anti-discriminatory and humanizing rationalization through the paradigm of conflict. To this end, the criminal legal assets can arise as a structural element, fundamental to all criminalization. However, the history of theories of criminal legal goods, unanimously based on consensus, shows its increasing expansion and delegitimization, reaching an attempt to extinguish it. The present work preaches for a resumption of the theory of the criminal legal good, in a reductive aspect of the punitive power, to limit the state criminalizing power |
