The present work aims to discuss the patrimonial reflexes projected in the legal system due to the promulgation of Federal Law n. 13,146, dated July 5, 2015, named the Brazilian Inclusion of Persons with Disabilities Act (Statute of the Person with Disabilities). This legislative intervention, originated from the mandatory content of the International Convention on the Rights of Persons with Disabilities, has confirmed the fundamental rights of persons with disabilities, with the purpose of their emancipation and social inclusion. However, as will be seen further on, the partial repeal of Articles 3 and 4 of the Civil Code of 2002, has generated profound changes in the ratio of the disability theory, so that the present analysis of its reflexes in the legal spectrum is of substantial importance, especially regarding the practice of contracts |
