This dissertation aims to present a scientific approach to the appearance theory in Brazilian law, without, however, exhausting said topic. The definition of the word "appearance" and the meaning it conveys in law were used as basis to properly understand the appearance of legal right. Considering that the appearance theory is found in the Brazilian legal system and that cases which demand its applicability have become more frequent, this research intends to clarify what are the requirements and grounds based on which, in certain cases, in order to protect a third party who has acted in good faith, transactions which are only seemingly real are considered valid and effective, even though in normal circumstances, as a rule, they would be invalid. This study also analyzes the legal effects produced by the appearance theory and its most common occurrences in Brazilian Civil Law, which relate to apparent mandate and apparent representation, apparent creditor, apparent ownership, apparent marriage, and apparent heir. In conclusion, by applying said theory, vices of form and substance may be overcome so that a legal act based on appearances is sustained, thus preserving its effectiveness, in order to uphold the trust and legitimate expectations placed on it by the third party who has acted in good faith |
