Resumo: This study aims verifying the positive impact of the work developed during the sentence in the process of resocialization of the prisoner. Thus, it will be necessary to present a brief history of the punishment and resocialization, as well as the evolution of the penalty and the penal doctrines over time, including the one adopted in Brazil and its efficiency for the desired resocialization of the prisoner, allied to the constitutional principles that guide the penalty. The core of this paper will be the analyses of the effectiveness of criminal enforcement rules, especially those related to labor while serving the sentence, and to confront them with the reality of the São Paulo State prison system, in order to establish a parallel between resocialization and social reinsertion of the person in society. What is noticeable, in fact, is the existence of a gross mismatch among the existing legislation and the reality of the prison system, since prison overcrowding does not allow all prisoners to have the opportunity to work and study. In view of this, one must advocate for creation of alternatives to offer work opportunity to the prisoner being re-educated, during and after serving the sentence, through public-private partnerships and other means, in order to achieve the desired resocialization and reinsertion of the person in society
