The actual world demands an adequation of the Legal System, each time more intense and constant, in order to improve the protection of the different interests protected by the Law and, as a result, to solve quickly the conflicts submitted to the Judiciary. This study has the objective of analyzing the liberty given to the judge in verifying the suitability of the preliminary extent. In fact, facing unknown or vague concepts given by the Law in the urgent measures, the appreciation of the Judiciary and The liberty given to that appreciation comes into question. For that analysis, initially the discritionarity of the judge was examined as a whole: the concept, the legitimacy and the limits of the administrative discritionarity, calling attention to the importance of constitutional principles to the solution of this matter. Afterwards, the structure of the Judiciary was studied, including his historical evolution, and given emphasis to the person of the judge and his work of evaluation of evidences as a way to aim the plein access to Justice. Finally, the jurisdictional protection was examined, giving especial attention to the urgent preliminary extent, such as preliminary measures and the anticipation of the effects of the sentence, and analyzing vague or unknown concepts that as part of the legal type, searching a conclusion for the possibility or not of the judicial discritionarity in completing this vague concepts, in order to give the urgent extent demanded |
