Leniency programs have grown in prominence over the last years; however, their embryonic stage, coupled with insufficient regulation and the lack of research on this topic, has triggered a cascade of problems in this area. These troubles have only grown with the increasing number of celebrated leniency agreements from 2013 onwards. Thus, given the relevance of the discussion surrounding leniency agreements, this paper aims to both demonstrate and delineate the functionality of leniency agreements and, via interpretation aligned with the Federal Constitution, their corresponding resolution potential. To facilitate this, the paper has been divided into three principle parts. The first part focuses on the historical context of Brazilian leniency agreements. Here we contemplate the legal aspects of relevant legislation, through definitions gleaned from Brazilian jurisprudence and literature. In the second part, we have performed an analysis of the related judicial policies, exploring the requirements for the existence, validity, and effectiveness of leniency agreements (escala pontensiana) and culminating in judicial control of the requirements for both the validity and the efficacy of the leniency agreement. Thus, this study is aimed at the current scenario, with particular attention paid to the constitutionality of the requirements made in the leniency agreement and the control thereof, which is mainly exercised by the Federal Supreme Court. Ultimately, we intend to answer the question of whether the escala pontensiana (previously mentioned) is being observed (or not) in the agreements that have been executed and later subjected to judicial scrutiny.
