Resumo: |
The object of study of the thesis is the Brazilian Autonomous Social Services and the constitutional rights of the citizens: the constitutional concept founded in article 6th of the Brazilian Constitution. Therefore, the delimitation of the study is the autonomous social services, specifically the constitutional concept. With this purpose, the intention is to answer if the phenomenon of the creation and performance of social services conflicts with the Federal Constitution of 1988. The intention is to test and confront the criteria already established by the jurisprudence of the Brazilian Supreme Federal Court and answer adequately and necessary the theme under the bias of its constitutionally adequate concept, demonstrating the importance of the thesis and adding something new to the already known. Certainly, from this delimitation, the objective is to promote a reflection on the historical trajectory and current legal organization of Autonomous Social Services in Brazilian law, their legal nature, the concept and the legislative changes that Brazil could implement to improve the legal regime of Autonomous Social Services, and verify how the 1988 Federal Constitution outlined its concept |
