Resumo: |
The object of the present work was to carry out a study of the forms of control of medical expertise carried out in the social security administrative process of granting or refusing the benefit for permanent disability and its consequences in the life of the insured. The work makes an initial analysis regarding the compliance by the insured with the general social security system, the necessary requirements for the granting of the benefit and the verification of his incapacity through administrative medical expertise. Chapters were dedicated to the study of the administrative role of the State in the person of the National Institute of Social Security - INSS, its guardianship in the analysis for granting or denying the benefit for permanent disability and forms of internal and external control of administrative medical expertise. The deductive method was used, having as initial term the systematic verification of the current legislation in its constitutional and infra-constitutional dimension in line with practical questions of the social security administrative process |
