A água como bem jurídico autônomo: proposta de um novo sistema de tutela penal

Resumo: It takes care of a doctoral thesis entitled “Water as an autonomous legal asset: proposal for a new system of penal guardianship”. Starting from the premise that the current model of penal protection of water, composed of the crimes of articles 270 and 271 of the Penal Code and article 54 of Law 9605/98 is insufficient, I formulated the hypothesis of water autonomy as a legal good - autonomous penalty under two different angles: water as an environmental element, properly speaking, and an environmental element linked to cultural, landscape and tourist heritage. Basing the hypothesis on the theory of the legal-criminal good, I constructed two types of penalties to be inserted in the Environmental Crimes Law, in this case the crime of water pollution through the release of pollutants in that, and the crime of aesthetic water pollution. The new system, therefore, is based on the various forms of aggression supported by water. Two concrete cases are presented, linked to the Tietê and Paranapanema rivers. Finally, I confirmed the hypothesis previously formulated with the hypothetical application of the model now proposed based on two judgments, one from the São Paulo State Court of Justice and another from the Paraná State Court of Justice
