O “hate speech” e as contribuições do constitucionalismo multinível para o seu enfrentamento

Resumo: This work concerns the topic or study of “hate speech” in the scope of Constitutional Right. The relevance of the investigation is revealed when the serious violations of human and fundamental rights caused by this discourse on the part of society are verified, allied to the absence of satisfactory answers for the confrontation of the issue. In this way, this research has the general objective of analyzing the possible restrictions on freedom of expression, regarding hate speech, and examining how the International Human Rights can contribute to the fight against hate speech. The specific objective of this dissertation, in turn, consists in the search for two safer routes to combat “hate speech”, based on the examination of decisions of the Supreme Federal Court and Inter-American Court of Human Rights, in order to achieve effective protection of the human dignity of all the actors involved. Therefore, the approach method used was deductive and the chosen procedural methods, either historical or comparative. In addition, the following formats are used as research methods: a) bibliographic research, analyzing publications understood as relevant to the study of the subject; b) the case study, aiming to analyze and compare various contexts in which the United Nations Organization, the InterAmerican Court of Human Rights and the Supreme Federal Court establish parameters in respect of the topic. Regarding the results obtained, it understood that confrontation of hate speech goes through two stages: 1. the collision between fundamental rights and human rights requires the application of the pro-person principle; 2. If there is still doubt as to what direction should prevail, the rule of proportionality, by Robert Alexy, should be applied
