In a social context marked by unprecedented technological advances, which have transformed the way society lives, interacts and, above all, works, it is essential to develop studies that understand the dynamics of new forms of labor, the precariousness existing in these new formats, the role of Labor Law and the difficulties in achieving Human Rights. The rapid technological evolution in the capitalist context, to the extent that it fosters the market, also asserts the precariousness of labor, since human labor is now managed by algorithms of app-companies, putting into debate the definition of worker and the rights associated with it. Objective: in this scenario, this research aims to answer how Humanist Capitalism contributes to the reduction of the precariousness of labor in the scope of app-companies. Methodology: the deductive method is used, through academic research with a qualitative approach, with the objective of exploring and understanding the dynamics between the application companies and the workers. The choice for a qualitative approach is justified by the intrinsic nature of the object of study, which demands a deep analysis of the theoretical, legal, ethical and practical implications of this labor relationship and the contributions of Humanist Capitalism on the subject. Results: a detailed examination of the historical periods covered shows how labor, since Antiquity, has been influenced by economic, political and cultural factors, reflecting dynamics of power and inequality that remain in essence to the present day. By examining the foundations of capitalism, the specificities of app-based companies and the challenges faced by workers in the digital environment, it is outlined how new technologies have transformed labor relations, expanding both opportunities and inequalities. The precariousness of labor within appbased companies is revealed as a distinctive element, structured by means of algorithms and codes programmed by the interests of the company, which determine decision-making parameters with a direct impact on the lives of workers. Humanistic Capitalism, based on constitutional principles, is presented as a viable alternative to mitigate the precariousness of labor within app-based companies, as it reconciles the integration of the three dimensions of Human Rights. Conclusion: the results obtained suggest the mobilization of society and political leaders around the precariousness of labor in view of new technologies, through the application of the philosophy of Humanistic Capitalism. It is essential to build a regulatory model that recognizes the specificities of new forms of labor involving digital platforms, so that app-based companies achieve healthy economic growth, while ensuring workers' rights |
