The objective of this research is to deepen the analysis of one of the main instruments used by Startups to attract and retain talent in a scenario of great uncertainty, high volatility and restricted financial resources: Vesting. Initially, a parallel will be made between liquid modernity, a concept by Zygmunt Bauman, which describes the fluidity and instability of relationships in today's society, and Startups, which represent agility and the ability to quickly adapt to the market, reflecting the search for solutions innovative and flexible in the face of the constant changes and uncertainties of the contemporary world. Next, the Startup concept will be explored in greater depth, an innovative business model, often based on technology, seeking rapid growth and scalability in a high potential market. The legal cycle of a Startup will be addressed, involving the main connections between the trajectory of this new business model, the need for responses and adaptations that the legal system must provide. Along these lines, the Vesting instrument, frequently used by Startups in their relationships with employees, will be specifically explored in depth. Given the atypicality of Vesting, the legal framework necessary to adapt it to the national order will be analyzed, as well as the most relevant characteristics and peculiarities. With this study, we will seek to define the legal nature of Vesting, in order to understand its applicability |
