The society witnesses nowadays one of the greatest technological revolutions experienced by humanity and is about to take greater risks through advances in technology. The influence of digitalization on the human being and the inherent risks, if used by malicious people, bring the following question: how to solve it? Digitization and its mechanisms bring the need to rapidly build systems for the protection of fundamental rights, currently inserted in the field of personal data privacy. The understanding of the influence of digital law, even if addressing the issues of data privacy, does not cover the totality of the current human being; man is studied by the sciences as a biological and social being. Quantum theory is used to explore how the multiple dimensions related to data protection can be properly applied simultaneously and seamlessly into the Technology landscape. From these perspectives or dimensions, the constitutional principles of privacy, the protection of personal data and human rights must be in harmony to ensure the safeguarding of the human being in the technological context. It is intended herein to propose the continuity of the thought of the sociologist Edgar Morin about the man interpreted as a complex being formed by several elements, now including the digital; therefore the virtual starts to influence the biological in its conception. The second thought and research refer to the application of the Humanist Capitalism as the basis of fraternal society in the modern digitalized world, as the only structure that will be able to provide the necessary guarantees for the protection of human beings, not discarding all other initiatives which will no longer be isolated actions. The research method applied is deductive. It is an academic, qualitative, theoretical and descriptive research, which approach will be the bibliographic review of books, scientific articles, dissertations and theses of national and foreign authors that deal with the influence of digitization on the human being, as well as the documentary review, through legal regulations and international treaties on the subject. In view of the challenges of technology and in defense of human rights and fundamental principles, the proposal of this research brought the Humanist Capitalism as the only structure capable of becoming the foundation for the formation of society that will also protect human rights found in the digital world |
