The present research aims to discussing the protection to author property rights onworksresulting from non-autonomous Artificial Intelligence, as well as protecting propertyrightswhich stem from these works. It is analyzed whether Brazilian legislation is appropriatetoprotect author rights and also who are the right holders are. Considering the advanceoftechnology and the globalization, the analysis of the Law no. 9.610/98 and its compatibilitytothe current moment is notably relevant, especially concerning the classification of theworkdeveloped by Artificial Intelligence. Likewise, author right is an intellectual right whichaimsto protect the author of the work, in other words, the presence of the creation of themindisrequired, according to the determination of the article 7 of the aforementionedlaw. Theimportant fact is to understand who creates the work produced by non-autonomous ArtificialIntelligence, where inspiration comes from and whether there is the presence of thespirit ofmind. Thus, the current paper analyses and concludes how the protection to the workproducedby artificial intelligence should be addressed, seeking a balance in the legal world |
