Resumo: | The present research analyzes the role of criminal reports within the Brazilian Penal Justice System, based on the construction and crisis of modern Penal Law. Beyond the demand of the reports at the current judicial order, this study seeks to question if the officially stated purposes may reveal the convict’s merit, and thus their feasible resocialization, in order to serve as supporting and essential material for the trier to treat sentence incidents like regime progression, and parole. Violence, as the main field, is present within both law enforcement by the State, and its taking care of crime itself. The research focus on “Criminal Policy, State, and Limitation of Punitive Power” it is the basis of criminal report analysis, as an instrument of the offender’s evaluation, since, in the text, they are treated like punitive State control over the convict proper, limiting the possibility of their reintegration into free society. |
