Os limites do poder de reforma da constituição

Resumo: This work aims to deal with the limits of the Constitution reform Power, having in view the competences and limitations that are determined by the Originary Constituent. An analysis is made from the Constitution in the hegeliano’s thinking, going through the Constitution conceptualization, its functions and its rankings. It analyses the Originary Constituent Power and the Reformer Constituent Power, as well as its limits. It studies the real case of the Constitutional Amendment Proposal in proceduring at the National Congress that deals with tax renewal and concludes that it has got uncountable unconstitutionalities. With a systematic analysis, it seeks to answer if the countless constitutionals changes via Amendments cause a risk of discharacterization of Constitution as it was written by the Originary Constituent. Owing to this, it concludes that the Constitutions are alive and need to adequate themselves to the “mind time”, but that these changes can not imply in a loss of original identity of Constitution. At last, it proposes alternatives to solve the Amendments high prolificity that today thrive in the National Congress on behalf of a false non governability and as a way of allowing that our Magna Carta can be reviewed periodically, as the Portuguese Constitution and without this means risk of deprivation of rights loss and fundamental warranties and of the petreas clause.
