Resumo: The investigation proposal of this study approaches the thematic of student assistance in the Federal University of the state of Rio Grande do Sul (UFRGS). We studied the constitution of UFRGS’ Student Assistance Policy alongside studentsoriginary from public schools who are users of this service in the institution. The analysis broaches on the meanings of the Student Assistance Policy, its materiality, the right to Education, to permanence in the University and affirmative action. It is a qualitative research with quantitative data, based on the dialectical-critical method and on historic materialism. The technique used to analyze the data is content analysis. The results of the research show the instability of the Student Assistance Policy, which sometimes assures the permanence of the student and sometimes excludes them based on a number of aspects that condition the continuity of the benefits offered, precariousness of the actions that focus on the permanence, prejudice. The construction of the Student Assistance policy was established under the influences of international organisms, whose logic views education as merchandise and believe social policies should be focalized. In this way, education will attend the market’s demand instead of having a formation commited to criticismo, and the Student Assistance Policy will not comprise all who need it to stay in the University.
