The present study has as its theme the Student Assistance Policy and enforcing rights for students who join the federal institutions of education in Rio Grande do Sul. This qualitative research, supported by quantitative data, is based on materialism dialectical and historical, and theoretical frameworks start from areas of Education, Social Work and Social Sciences. As a problem to be solved by this study, we can ask: How the educational policy of student assistance was effective in holding rights to students of federal institutions of education in Rio Grande do Sul? And about of the central objective of the research aimed to investigate how educational policy is effective for student assistance in holding rights to students who enter these institutions. As sources of study was used focus groups with technical and administrative staff in education, managers and students of the Universidade Federal de Santa Maria and the Universidade Federal do Rio Grande do Sul, in addition was used analyzes of institutional documents such as resolutions, laws, management reports, tables of budgets and institutional historic. To analyze the data obtained was used the content analysis, based on quantitative and qualitative data obtained in the federal universities and specifcs groups. The results allow to identify the policy adopted by governments in last decades show us the university “new” reform, which bounces off the retreat of college education policies to become more diverse, flexible and competitive with cost containment, as market trends. The student assistance, as part of that context is materialized as a policy in the creation of three distinct phases, which add historical and political obstacles, resulting from the rapid process of expansion and democratization of public college education in Brazil. The limitations are the constraints to the equalization of human rights to education in times of recovery of neoliberal policies and the hegemony of markets, associate student assistance to the “service logic” and not of law. The possibilities and limitations related to the guarantee of rights for students in the federal institutions of education reveal a dynamic between the way and uncertain-way in the formalization of student assistance in the country, which can be hidden the protectionist tutelage of State, the logic of market that affects the creating of the programs and naturalization of the social question.
