Resumo: | The present paper discusses the importance of the credibility of the National Financial System, which is constituted by several financial institutions who need authorization of the Brazilian Central Bank in order to operate in the Country. The capture, intermediation and investment of financial resources, seeking profit, are exclusive activities of financial institutions. Law 7. 492/86 protects the National Financial System and foresees, on article 16, confinement punishment to individuals that “make operate” a financial institution without the proper authorization of the Brazilian Central Bank. The Financial Activities Control Counsel is the responsible agency for the investigation of illicit financial activities. A vulnerable and unstable financial system weakens the country’s financial credibility, giving up the attraction of external investments and generation of wealth. Crimes practiced against the National Financial System are one of the antecedent crimes of money laundering, which is foreseen in Law 9. 613/98. The countless harmful effects of money laundering, which to be characterized as such, presupposes the existence of preceding crimes that are: the traffic of narcotics; the contraband or traffic of weapons; terrorism and its financing; the kidnapping for ransom; the crime practiced against Public Administration; the crime practiced against the National Financial System; crime practiced by a criminal organization; crime practiced by individuals against a foreign public administration. Thereby, the investigation analyzes, within the research line of contemporary judicial-penal systems, when a criminal activity can be considered owned or exclusive of a financial institution and, especially, which peculiarities distinguish the simple attainment of advances or contracts of mutual pecuniary, practicable by any individual, from the custodial activities of the financial institutions through bibliographical research and study of an actual case. |
