Resumo:	This work, linked to the Research Line of Legal-Penal Contemporary Systems, aims to examine and establish the basis for understanding the problem of criminal punishment. To this end, intends to seek a new perspective on the subject, historically divided between preventive and retributive theories. Firstly, seeks to be rigorist in the concepts used, thus avoiding mistakes in the analysis of the object in question. Secondly, analyzes the retributive theories derived of the common law, among which stands out Duff's communicative theory, studied in the third chapter.
