Resumo: The present report is linked to concentration area of “Criminal System and Violence”, and to the line of research “Legal-Criminal Systems Contemporaries”. In this way, it aims to analyze the legal-criminal aspects of the exceeding embryos of the fertilization in vitro, initiating for the constitutional law, expounding about the involved basic principles, as the right to the life, to the scientific development and the reproduction, as well as their civil aspects and legal nature. Front to the identification of the well-criminal legal involved in the behaviors as the production, the commercialization and the destruction of the exceeding embryos, analyzes the existing legislation on the subject and looks for to identify the existence of well legal guardianship. By means of the study of the principles of criminal politics as the dignity and criminal necessity and, still, the principle of ultima ratio, it acts for the unjustify of the criminal law in the guardianship of the related behaviors, in view of the possibility of that, with equal, or greater effectiveness other branches of social control make it. As well as, it argues that the existing legislation, as the Law of Biosecurity, protects the embryo in vitro according to the constitutional dictates and in compliance with the interpretation of the Supreme Federal Court about the constitutionality of the use of the related embryos for purposes of research, by means of the observation of certain requirements.
