Resumo: This work aims at proposing a reflexion on the private sphere at present days, having in mind that, in post-modern times, the principle of privacy constituted as such and built especially in the 19th century, is not held. The analysis will take into account the practices observed on the Internet, which appear to indicate that, at present times, the private space perceives another format. Starting from the assumptions of the Comprehensive Sociology, we intend to verify past and present social manifestations and the way the public/private dichotomy has been perceived up to now. We also analyze how the individuals make use of the new communication technologies and how they provide a high exposition of privacy, favoring the modification of the private sphere. Completing the discussion about the theme, we propose to observe some criminal occurrences on the net which harm the guarded right to private space, according to what is foreseen in the Brazilian legislation. This way, we analyze how the classic cases of privacy invasion, in an environment that does not have specific regulations like the internet, are being solved. At last, this paper aims at pointing to a necessary discussion that starts by the following question: in post-modern times, considering means like the internet, is the private sphere held or it is condemned to a reduction, demonstrating a renewed valuation of the public space?
