Resumo: | This monography raises the research about popular participation process brought up in the city of Porto Alegre, RS, Brazil – wich public resources destination has been decided, since 1989, by the citizens. The research intends to analyze popular participation in the whole decision and application process of public resources, making use of the experience in the capital of Brazil’s sulist state, and trying to comprehend such experience in its democracy contribution aim. Once observed that classic democratic model is not enough to supply citizens necessities anymore, and that it is necessary to it assume the guarantee of common rights that come from citizenship – civil, politic, social, economic and cultural – the development of a new democratic model raises up – a model able to enlarge the concept of Democracy itself. The concept and the value of democracy have been discussed inside the context of State, so as the way to exercise it. The only power taken into account is the sovereign power, which gives itself the right of limiting and controlling laws and judicial entities. In this context, Democratic Sate of Rights (by theoric definition) gives place to democracy concretization, once brought up effective and real. The power relationships, being juridical, are made bigger by de fundamental rightsmaking the simultaneous relaization of equality and freedom principles happen. The questions about the edges of democracy in nowadays society are, mainly, in the effects of globalization phenomenon. That is the place where many arguments against its possibility in face of State-Nation sovereignty destruction appear, in front of the existance of over national decisions centers. The worries about sovereign power model are evident – as it has been used by the State, even in hands of structures that are over its boundaries.Popular participation in the political process decisions – and not just electoral anymore – has been one of the solutions pointed out to Democracy crisis. Through popular participation, we have sicil rights increased, as well as its persecution and defense, by direct ways. Popular participation is a “weapon” of resistance against social exclusion and marginalization inherent to globalization and its politics. In that process, the cities have an strategic role. With the State-Nation crisis and the over national development of structures come the competence and responsabilities transference to local or regional authorities. Logically, that transference gives new power to those authorities, increasing their relevance in the political context. The best field to the effective citizens participations in politics is the municipal govenrment itself. However, few are the cities that develop participation in the sense of democratic radicalism, really done through popular participation in public administration. Popular participation is an important instrument to the deep view of democracy, which, coming from decentralization, makes participation more dynamic, mainly in local proportions. According to popular participation principles, there are new relationship possibilities between State and civil society. Popular participation aims to estabilish a union between State and civil society, so that, together, they may reach the objective wanted by everyone – the increasing of good life conditions to all population. The Participative Resourcement is a space of argument an reache’s definitions to the city. In ti, population dicides the priorities of investments in buildings and services to be done each year, with municipal public power resources.The monography presented here intends to develop an analysis about social an juricial points of view, paying special attention to the question of legal regularity in Participative Resourcement and in is autonomy, while way of popular participation in the destiny of public power and in the effects of that participation to democracy and to municipal legislative structure. |
