This paper presents, as its main proposition, the search for efficacy of workers fundamental rights through their labour union, matter that brings about the discussion concerning the reformulation of the brazilian labor union structure. Certain defects that exist in the nation´s labour union organization end up obstructing the encourage of the unios, attracting the focus of the discussion to already surpassed issues in the international level, instead of actually debating the union´s actions and future of unionism in face of economic and social context. This represents losses for all of the participants in the labour world, and it´s lack of progress leads to a rigid and extense labor law, uncapable of dealing with modern work realtions and dynamics, which also reflects the overload of Labor Courts. These and others intricate matters are put forth in this paper. To do so, a historic review of unionism around the world and in Brazil is made, culminating in a contextual analysis of the Brazilian reality. A study about the United States union structure is also made to serve as basis for the necessary reform of the Brazilian labour union organization. Thereby the end result of the paper is to consolidate a better union structure for Brazil, to allow the existence of strong and representative unions, which is the object of the chapter two of this paper. In the end, the unions obligation to give efficiency to laborer´s fundament rights is analysed, especially through attendance.
