This thesis addresses the theme of the expansion and exploitation of fissured work through various configurations on a planetary scale, with recruiters on different continents, from a transnational perspective, causing an imbalance of power between companies with an anti-competitive vocation and demanding regulation of transformations that are being experienced in international economic relations. It is noted that the contemporary era is not marked by a major rupture in the history of modern individualism, witnessing a hyper-intensification of certain values, hence the term hypermodernity, used by Gilles Lipovetsky. Thus, there are clear contradictions: on the one hand, the effective generation of wealth and discussions about Society 5.0 and Artificial Intelligence. And on the other, the exclusion of the vast majority of the population, with the accentuation of inequalities, the re-discussion of minimum rights of the Industrial Revolution 1.0, in addition to the disregard for Human Intelligence. Thus, we will attempt to demonstrate the importance of investigating possible legal limits to power economic, in the face of the burning fissured work on a global scale, resulting from transformations in the economy and new technical modes of production. |
