The present study aims to analyze the concepts of water governance and public policies related to the water resources, mainly the PCJ Watershed, which supply the Metropolitan Region of the City of São Paulo (RMSP). By means of a broad bibliographic review, the natural resource water is analyzed as having special characteristics, which make the decisions on its use to have an even greater impact on the RMSP, mainly due to the water stress that the region is currently facing. A brief review is presented regarding the evolution of the water legislation, in Brazil and in Sao Paulo, in order to show the legal milestones of the water resources management. The establishment of the watershed, as an administrative unit is shown as a model of governance, and the Watershed of the Piracicaba Capivari and Jundiaí Rivers was chosen as an example, once the PCJ Watershed contributes to the water supply of the RMSP, by means of a grant from the Departamento de Água e Energia Elétrica (DAEE) to the Companhia de Saneamento Básico do Estado de São Paulo (SABESP). Due to the fact that the said grant will expire on the 6th of August 2014, the way the water governance is practiced is a determinant factor for the future of the water catchment in order to not to compromise the supplies to both the RMSP and the region of the BH-PCJ. |
