Resumo: The right to a name as a personality right is a topic of relevance for transgender people as it was imperative to file a lawsuit for the rectification of first name and/or gender to make it possible to change and proceed to rectification the official documents. With the publication of Provision nº 73/2018 of the National Council of Justice, there was the possibility of this process being done through extrajudicial, directly in Civil Registries of Natural Persons. This dissertation aims to study whether the dejudicialization of the process can be considered a means of realizing human rights for transgender people and respect for the dignity of the human person for a social minority. To make this real, a study will be made about personality rights and the right to a name. In a second step, it will be necessary to define the object of study, and then bring the concept of gender transition. Once these points are established, an analysis of the impacts of this provision on transgender people in relation to the binomial cost/term will be made, through analysis of data in a quantitative and qualitative way, as well as exploratory research and bibliographic base, using the deductive method.
