Resumo: For many years the public authorities have been facing difficulties to order the interstate and international passenger transportation sector in Brazil, in particular to increase competition, reduce market concentration and expand and improve the quality of these essential pubic services. On the eve of the largest public tender in the sector, in 2014, a major overhaul of the sector was proposed by lawmakers, with a new regulatory model to liberalize interstate and international transportation services as a solution to overcome entry barriers, hindrances to competition and “straight jacket” regulations. This led to authorization of new players for the provision of interstate and international bus services. The objective of this work is to examine the past and present challenges faced in the search for a suitable regulatory model for the bus transport sector under the authority of the federal government, including a critical evaluation of a new regulatory framework. In this respect, the focus is on deregulation of the sector, describing the objectives that should be pursued and the instruments that should be adopted, in light of past failings, and also drawing parallels with other sectors and markets. In the end, some proposals are presented to improve the rules under a new regulatory framework, so as to optimize competition.
