Although the health' s right was contenpleted by the 1988' Constitution issues of management, administative and budget as others, restrinct the operative competence of agencies and entitiesv that leads to a phenomenon called judicalition of health' s right. This phenomenon is observed whem people adopts the enterprise to search to judicial power to have the right of resources needed to improve their clinicai conditions. While the health' s attention must be entire comtemplats ali people needs, o phenomenon is also observed whem the patient searchs justiceto garantee his acess to medicines which could be given free by public power. The present dissertation tries toapproach the question of medicines acess in Brazil given by justice, beyond the Health' s Municipal Agency ( SMS_RJ) .This will be crumbled by main difficulties faced by this agency with the atribution to execute the determinations of judicial power to considerwhat was required by society |
