Resumo: This Thesis was designed to qualitatively evaluate the current administration of the penitentiary system in the state of Espirito Santo by establishing a chronological line in the increase of state prisons’ population in relation to the prisons’ current configuration. Thus, it presented alternative propositions highlighting the juridical and socioeconomical predicaments to secure dignity and human rights to the incarcerated. Moreover, in the same context, the co-relation between the State, public and private spaces was also a point of discussion targeting the ethics of subcontracting; with its main focus on the Spanish model, in which the State subcontracts services for its penitentiaries. Finally, this study was intended to reflect upon new Public Policies to guarantee dignity in the treatment of the incarcerated in light of national and international legislations as well as the authors’ reflections.
