Resumo: | The study aims to indicate interpretative elements that contribute to a proper interpretation, understanding and application of contemporary environmental law through the philosophical hermeneutics, in the Brazilian Prosecution. There has been a policrise of modernity and an ecological crisis, because of the one-dimensional Cartesian model adopted by humanity in the last two years. Further, it discusses the construction of Environmental State, identifying inefficiency in resolving the installed ecological crisis. It is observed, therefore, the ineffectiveness of environmental law, examining its positivation, their weakening and the scenery that surrounds the serious environmental crisis. Subsequently, it analyzes the misunderstanding of environmental law by Brazilian Prosecution by criticism of his extrajurisdicional performance, still ruled today in positivistic hermeneutics, showing the need for an institutional reform of how the environmental law is understood. In this context, it analyzed the Gadamer's philosophical hermeneutics and its influence on law and environmental law. Once the Environmental State is governed by the principles of solidarity and participatory democracy, crucial for the demarcation of environmental issues, it dealt with the constitutional principles that guide the actions of the prosecution, as the main inducer of civil society participation in the extrajudicial procedure, It is indicated mediation as appropriate procedure to resolve environmental conflicts. The results confirmed the need to reform the interpretation of environmental law within the Prosecution, with the adoption of the Gadamer's philosophical hermeneutics elements within a communicative extrajudicial mediation procedure, for their suitability to the concerns of society and the consequent implementation of Justice environmental. |
