Controle jurisdicional de políticas públicas e a inserção das pessoas com deficiência no mercado formal de trabalho

Resumo: The current research, following the research line “Constitutional jurisdiction and the effectiveness of fundamental rights and guarantees” of the FDV Master in Fundamental Rights and Guarantees Program, analyzes the limitations to be observed by the Judiciary branch when it controls public policies already implemented for inserting people with disabilities in the formal market work. For studying such problem was elected as the dialectical methodology. The work is divided into three chapters. In the first, it is made an analyzes of the employed nomenclature for the people with disability, the concept of disability, the rights of such workers, in special the right to work as a kind of social inclusion. Besides it analyzes the effectiveness of the quota public policy fixed in the art. 93 of the Law 8,213/91, through vacancy reserve system, focusing the question of people with disabilities qualification. In the second chapter, it is analyzed the public policies judicial control. For this it is detached the concept of public policies and the types of controls that can be employed over the Public Administration acts, specially the judicial one, which, before the Brazilian current scenario, it is necessary for realizing rights, since some restrictions are observed. Finally, it is analyzed if such control violates the Brazilian Constitution of 1988, art. 2nd. In the third chapter are faced the limitations which the Judiciary must face when controlling public policies, specially the quota ones since the vacancies reserve system. For this, it discusses on the existential minimum, presupposition to the intervention, and on the general limits of reasonability and the reserve of the possible. After such analyses, are verified the limits that the Judiciary must face in an eventual control over the quota public policy for the inclusion of people with disabilities on the formal work‟s market. At the end, the conclusions of such thematic are presented.
