Resumo: One of the most intriguing thematics for those who deal with the Law is the question of access to justice that, in its modern design, is the result of the break of liberal bourgeois paradigms, with the promotion of a constitutional model based on the supremacy of human rights. The access of justice was elevated to the status of fundamental right by the Charter Policy of 1988. From this date on it started to mean the right of those who search the Judiciary for a solution of the conflicts by an effective judicial provision and guardianship, performed by a just process and subject to constitutional principles, developed in reasonable time and guaranteed by the exercise of a power-duty-function state that not only has to say, but, above all, achieve the right. In this context, along with the will to improve the results of the civil procedure, it was edited in 2005 the Law nº 11.232, abolishing the autonomy of the execution of sentence and adopting a syncretic model procedure. This reform represented a breakthrough for the realization of the claimed rights, but is still insufficient to hold the fundamental right of access to justice.
