Resumo: | This paper studies the restrictions and reductions of social rights in the European Union, analyzing the Social Welfare State and the principle of proportionality. As it is known, the Social Welfare State aims at the successive development of citizen protection, especially in its labor aspect, because it is where the dignity and centrality of the human being is based. From this perspective, the principle of proportionality and the Social Welfare State can serve as a guideline to understand the historical, political and social process involved in the policies of austerity and the changes and reductions of social and labor rights in the countries of the European Union. In this scenario, the paper explains the matrix opposed to Social Welfare State, which is known as neoliberalism, and investigates how this chain of thought has been seeking, in an extreme way, to reorganize the relationship between State, society and the market, guaranteeing the success of the model placing the financial market as central actor of the political-economic regulation. In addition, it studies the ideological political clash present in the most diverse founding documents of the European bloc and even in the jurisprudence of the Court of Justice of the European Union. Equally, how this conflict has contributed to the weakening of the European Comunity, especially in the context of welfare policies. |
