Resumo: The pharmaceutical is one of the most innovative industries if compared to other industrial factors. Since the end of XIX century, when chemistry and pharmacology development starts, it dedicates its best efforts to the invention of new products. It is an industry that transits among several sectors and which researches influence them, causing changes and generating debates. The goals aimed through this paper try to analyze how legislation, such as laws, rules and so, expand and broaden the research and innovation activities, and also contributes for the survival capability, in the long term, of companies from the pharmaceutical arena. This essay tries to analyze how the legal set of the Brazilian pharmaceutical industry innovation system influences the innovation trajectory, research and (non) innovative pharmacists between 1996 and 2007. It is part of the theoretical structure, which is necessary to give support to the paper itself, concepts about innovation, innovation sector system and appropriability. The used methodology was based on “grounded theory” using, along with interviews and unstructured chats, the utilization of qualitative and descriptiveexploratory-meaningful research, which helped to format this paper. Its data were based on primary and secondary sources. This study concludes that there is an “information” sectional system and presents a draft of it, as well as it follows the trajectory track along the studied period. It confirms that the biggest innovation growth is found in the legal copy area and that there are few advances in invention. Through it, it is possible to verify that appropriability has focused more on factors such as confidentiality and “lead-time” than on patents. It is seen that there is no structure at the sectional system focused on radical innovation, and, mainly, it shows the use of ruling structure in order to create difficulties to the Brazilian radical innovation.
