Resumo: The present work brings a reflection on the state consumption model, questioning the mode of acquisition of goods and services by the Government itself, through the so-called sustainable public contracts or sustainable bids. As a result, the attempt to identify and examine the means for their implementation within the scope of the Federal Public Administration is a problem. In this light, the general objective is to verify the existing challenges and propose legal solutions so that sustainable public procurement becomes a routine, wide and comprehensive practice. Based on this, we seek to understand the issues pertaining to the current pattern of production and consumption in contemporary times, to gather the theses that challenge such an unsustainable consumption model, to understand the constitutional and legal context of sustainable bids in the Brazilian legal system and to identify the main barriers that prevent sustainable development from becoming a practical reality of federal bidding procedures. In this regard, adopting a qualitative research methodology of bibliographic review and hypothetical-deductive approach, it was concluded that although the Constitution, through the combination of arts. 3rd; 37, XXI; 170 and 225, has made a principled commitment to public procurement aimed at achieving sustainability, there is no evidence of its implementation, making it essential to think of legal solutions to overcome the main challenges faced by the Administration, such as the resignification of budget planning ( PPA, LDO and LOA), the training of bidding teams aimed at sustainability, the application of sustainable labeling and certifications, the adoption of the price registration system to strengthen the state's purchasing power in favor of sustainable development, the improvement of public procurement monitoring and evaluation programs and the development of sustainability control.
