Resumo: | This master’s thesis analyses the transnational law as a potential solution for a regulated e efficient carbon offset market, ahead of the climatic change struggles e the need for a new sustainable development path. The research takes an interdisciplinary approach the aims to integrate the legal, economic and environmental dimensions of the question, revisiting the evolution of the environmental thought both in the Brazilian and in the international context. Initially it stands out the environment as a fundamental right, emphasizing the historical challenges and the legal instruments for its protection. Following the thesis explores the relation between environment and economy, highlighting the role of the corporate responsibility and the ESG as mechanisms to incentivize sustainable corporate practices. Investigating the democratization e the regulatory challenges of the carbon offset market the study shows the loopholes in the current normative system and propose the transnational law as an harmonizing instrument, capable of integrate different legal ornaments and promote effective environmental mitigation measures. The methodology funded in bibliographic revision and documental analysis, sustains the conclusion that the transnationalism offers a promising alternative to align the economic and environmental agendas, contributing to the implementations of new global policies to face the climate change. |
