Economia circular e humanismo: regulação para práticas empresariais sustentáveis a partir da filosofia empresarial de Brunello Cucinelli

Summary: | Legal science currently faces a great challenge, that of presenting solutions and propositions for a sustainable development in its triad, that is, in the environmental, economic and social aspects. It is necessary to do it in the face of a hegemonic economic order that compromises its human and social values. The environment urges new propositions, since the form of operation in a linear system, like the contemporary one, exhausts both natural and human resources, in this context the present research presents the Theory of the Circular Economy and all its reasoning so that, having nature as an archetype, it is possible to make a circular production system feasible. The economic aspect is also addressed in the aforementioned theory insofar as it proposes, broadly, four business models that allow the new proposals to materialize. It occurs that the said theory does not address the three elements of the sustainable development, dispensing, therefore, of its neválálico element, that is, the human being. With the intention of filling this gap left by the Theory of Circular Economy, we present the proposal of a Theory of Humanist Economy, demonstrated in practice by the Italian businessman Brunello Cucinelli, who, inspired by Greek, Roman, Renaissance, in art and religion, gave life, in the small town of Solomeo, Italy, to a company whose basic principle is the dignity of the human person, but which operates without neglecting the search for profit, thus appreciating the element sustainable development. As challenging as it may seem to be, it is possible to implement a productive system in a capitalist economy that concerns both the human being and the environment. The proposed study refers to basic research, based on the operational logic of the deductive method and the qualitative approach. |

The proposed study refers to basic research, based on the operational logic of the deductive method and the qualitative approach.A ciência jurídica enfrenta atualmente um grande desafio, aquele de apresentar soluções e proposições para um desenvolvimento sustentável em sua tríade, ou seja, tanto no aspecto ambiental, econômico, quanto social. Ocorre que há que fazê-lo frente à uma hegemônica ordem econômica que compromete seus valores humanos e sociais. O meio ambiente urge por novas proposições, pois a forma de operação em um sistema linear, como o contemporâneo, esgota tanto os recursos naturais quanto os humanos, nesse contexto o presente trabalho apresenta a Teoria da Economia Circular e toda sua fundamentação para que, tendo a natureza como arquétipo, seja possível viabilizar um sistema de produção circular. O aspecto econômico também é abordado na referida teoria na medida em que a mesma propõe, em sentido amplo, quatro modelos de negócios que permitem materializar as novas propostas. Ocorre que a referida teoria não aborda os três elementos do desenvolvimento sustentável, prescindindo, portanto, de seu elemento nevrálgico, qual seja, o ser humano. Com a intenção de suprir essa lacuna deixada pela Teoria da Economia Circular, apresenta-se a proposta de uma Teoria da Economia Humanista, demonstrada na prática pelo empresário italiano Brunello Cucinelli, o qual, ao inspirar-se na filosofia grego, romana, renascentista, na arte e na religião, deu vida, no pequeno burgo de Solomeo, na Itália, a uma empresa que tem como princípio basal a dignidade da pessoa humana, mas que opera sem deixar de lado a busca pelo lucro, apreciando, assim, o elemento social do desenvolvimento sustentável. Por mais desafiador que pareça ser, é possível implementar um sistema produtivo em uma economia capitalista preocupara tanto com o ser humano como com o meio-ambiente.
