Summary: This paper aims to tackle the issue of constraints to constitutional interpretation in light of the Living Tree metaphor from the Canadian Constitutional Law. It further scrutinizes this doctrine in contrast to the Originalism and the Living Constitution doctrines developed in the United States. As a conclusion, the article acknowledges that the Living Tree metaphor has the merit for proposing a reconciliation between fixidity and flexibility in interpretation of the constitution. Nevertheless, in order to convey more objectivity and constraints to interpretation, it should be associated with consideration to precedents and incrementalism.

Centro Universitário Autônomo do Brasil2020-12-05info:eu-repo/semantics/articleinfo:eu-repo/semantics/publishedVersionapplication/pdfhttps://revistaeletronicardfd.unibrasil.com.br/index.php/rdfd/article/view/187410.25192/issn.1982-0496.rdfd.v25i31874Revista Direitos Fundamentais & Democracia; v. 25 n. 3 (2020): Revista Direitos Fundamentais & Democracia; 160-175Revista Direitos Fundamentais & Democracia; Vol. 25 No. 3 (2020): Revista Direitos Fundamentais & Democracia; 160-175Revista Direitos Fundamentais & Democracia; Vol. 25 Núm. 3 (2020): Revista Direitos Fundamentais & Democracia; 160-1751982-0496reponame:Revista Direitos Fundamentais e Democraciainstname:Centro Universitário Autônomo do Brasil (UniBrasil)instacron:UNIBRporhttps://revistaeletronicardfd.unibrasil.com.br/index.php/rdfd/article/view/1874/672Copyright (c) 2020 Revista Direitos Fundamentais & Democraciainfo:eu-repo/semantics/openAccessDiniz Araujo, Luiz henrique2022-08-30T18:54:15Zoai:ojs.pkp.sfu.ca:article/1874Revistahttps://revistaeletronicardfd.unibrasil.com.br/index.php/rdfd/PRIhttps://revistaeletronicardfd.unibrasil.com.br/index.php/rdfd/oairdfd@unibrasil.com.br1982-04961982-0496opendoar:2022-08-30T18:54:15Revista Direitos Fundamentais e Democracia - Centro Universitário Autônomo do Brasil (UniBrasil)false
